Terms of Service
These Terms of Service ("Terms") govern your use of the Zeropost mobile application and website (the "Service") operated by Zeropost ("we," "us," or "our"). By using the Service you agree to these Terms.
1. Description of Service
Zeropost is a mobile application that helps users reduce unsolicited physical mail by identifying senders from scanned mail pieces and submitting formal opt-out requests on the user's behalf via CAN-SPAM Act procedures and direct mailer contact. Zeropost also provides guidance on third-party opt-out services including DMA Choice and OptOutPrescreen.com.
2. Account Registration
You may use limited features without an account. To access full features you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to use the Service. By creating an account you represent that all information you provide is accurate and current.
3. Subscription and Payments
- Zeropost offers a free tier with limited scans and a paid subscription for unlimited use.
- Subscriptions are billed through the Apple App Store on a monthly or annual basis.
- Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
- Refunds are handled by Apple in accordance with their refund policies.
- We reserve the right to change subscription pricing with 30 days notice to existing subscribers.
- All prices are in USD and exclusive of applicable taxes.
4. User Responsibilities
By using the Service you agree to:
- Only scan mail addressed to you or that you have legal authorization to handle
- Provide accurate mailing address and personal information
- Not use the Service for any unlawful purpose
- Not attempt to reverse engineer, decompile, or exploit the Service
- Not submit opt-out requests on behalf of others without their explicit written consent
- Not use the Service to harass, abuse, or interfere with mailers beyond legitimate opt-out requests
5. Opt-Out Services and Authorization
By using the Service, you explicitly authorize Zeropost to act as your authorized agent for the purpose of submitting opt-out and removal requests to third-party mailers on your behalf. This authorization includes sending formal CAN-SPAM Act opt-out emails to identified senders using your name and mailing address as provided.
Important limitations you acknowledge:
- Zeropost does not guarantee that any sender will honor an opt-out request. Compliance is the legal responsibility of the sender.
- CAN-SPAM opt-out requests must be honored by commercial senders within 10 business days by law. However, Zeropost cannot enforce this on your behalf.
- Certain mail categories are exempt from CAN-SPAM including political mail, nonprofit solicitations, and transactional mail. Zeropost cannot stop these.
- Results vary based on sender, mailing list type, and applicable regulations.
- Zeropost is not liable for any mail received after an opt-out request has been filed.
- Mail already in transit or pre-printed before your opt-out request may still be delivered.
Zeropost provides guidance on third-party services including DMA Choice and OptOutPrescreen.com. These are independent services not operated by Zeropost. Use of these services is subject to their own terms and conditions.
6. Third-Party Services
The Service relies on third-party providers including Google Cloud Vision (image processing), Supabase (data storage), Resend (email delivery), and RevenueCat (subscription management). Your use of the Service constitutes acknowledgment that your data may be processed by these providers in accordance with their respective privacy policies. We are not responsible for the practices of these third-party services.
7. User Content and Data
You retain ownership of any mail images you scan. By submitting images to the Service, you grant Zeropost a limited license to process those images solely for the purpose of identifying senders and filing opt-out requests. Mail images are not stored after processing. Removal request records are stored to provide tracking functionality.
8. Indemnification
You agree to indemnify, defend, and hold harmless Zeropost and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
9. Limitation of Liability
To the maximum extent permitted by law, Zeropost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to continued receipt of mail after an opt-out request has been filed. Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that opt-out requests will result in the cessation of mail from any particular sender. We make no warranty regarding the accuracy of sender identification from scanned images.
11. Dispute Resolution and Arbitration
Any dispute arising from these Terms or your use of the Service shall be resolved through binding individual arbitration under the American Arbitration Association rules, not in court. You waive any right to participate in class action lawsuits or class-wide arbitration. This arbitration provision does not apply to claims for injunctive relief or intellectual property disputes.
12. Intellectual Property
All content, features, and functionality of the Service including the Zeropost name, logo, and app design are owned by Zeropost and protected by applicable intellectual property laws. You may not use our trademarks or branding without prior written permission.
13. Children's Privacy (COPPA)
The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you are under 13, do not use the Service. If we discover that a child under 13 has provided personal information, we will delete it immediately. Parents or guardians who believe their child has provided information should contact us at privacy@zeropost.app.
14. California Residents (CCPA)
California residents have additional rights under the California Consumer Privacy Act including the right to know what personal information is collected, the right to delete personal information, the right to opt out of the sale of personal information (we do not sell personal information), and the right to non-discrimination for exercising these rights. To exercise these rights contact privacy@zeropost.app.
15. Termination
We may suspend or terminate your account for violation of these Terms at our discretion. You may delete your account at any time from the Account screen in the app. Upon termination your data will be deleted in accordance with our Privacy Policy. Sections 8, 9, 10, 11, and 12 survive termination.
16. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. To the extent arbitration does not apply, disputes shall be resolved in the state or federal courts located in Texas.
17. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
